1 In the District Court of Bryan County, Case No. CRF-72-128, appellant, Ronnie Disheroon, hereinafter referred to as defendant, was charged, tried and convicted for the offense of Unlawful Delivery of a Controlled Dangerous Substance, Phencyclidine (PCP). His punishment was fixed at ten (10) years imprisonment. From that judgment and sentence, defendant attempted an appeal to this Court in Case No. F-73-104, which was dismissed for jurisdictionally fatal defect. Thereafter, defendant filed his application for post-conviction relief in the District Court of Bryan County. From the District Courts order denying post-conviction relief, defendant has perfected a timely appeal to this Court.
